To the extent permitted by law, Wētā Sydney is not responsible or liable for any liabilities (direct or indirectly or loses and damages) arising in any way for errors in, or omissions from, the information in this web site.

All pictures and photos on this site are sample representation of products and goods advertised and variations may occur from time to time.  Product descriptions contained in this website are based on information supplied by manufacturers and distributors. Whilst every effort is made by Wētā Sydney to ensure that the information is accurate and up-to-date, there may be instances where model details and specifications change, or when products listed on the website are not immediately available. We reserve the right to withdraw any items from sale.

Any links to external websites from the Wētā Sydney website are supplied for information purposes only and Wētā Sydney takes no liability for the accuracy and content of these sites. You access those sites solely at your own risk.

Wētā Sydney does not claim this site is free of any faults, viruses or defects; you are responsible for scanning any information for viruses.

You agree that Wētā Sydney holds no responsibility or liability for any person for loss or damage (directly or indirectly) which may be the result of any such information from Wētā Sydney. If Wētā Sydney is found to be liable this will be limited to the cost of supplying the information again.

If you have an order accepted by us, terms and conditions will apply to that order. We cannot vary terms and conditions to that order after acceptance. We however can modify terms and conditions at any time and once posted you agree to terms and conditions by using the site.

NO ORDERS FOR SPARES OR ANY PART OF THE ORDER CAN BE CANCELLED ONCE THE ORDER HAS BEEN DISPATCHED.

A representative of Wētā Sydney will contact you if there are any issues with your order to discuss and confirm the order, shipping arrangements and method of payment.

SHIPPING
We deliver using both Australia Post and commercial couriers.

Orders that contain Dangerous Goods, liquids, items over one metre in length, items over 22kg, and large size items cannot be sent with Australia Post. These orders will be sent by commercial couriers and cannot be delivered to PO Boxes or Post Offices.

Sails, masts and heavy, fragile, bulky and/or awkward items to freight may incur additional freight costs and/or increased delivery time.

BOAT PURCHASE DEPOSIT

A deposit of 20% is required for all new and used boat sales. If the order  is cancelled within 14 days of the deposit being paid, a full refund will apply. If it is cancelled between 15-30 days, 80% of the deposit will be refunded. No refunds will be issued for orders after 30 days.

Deposits paid on orders that are subsequently cancelled are refunded solely at the Wētā Sydney’s discretion

Payments:
All goods remain the property of the Wētā Sydney until full payment is received
The company reserves all its rights to recover all goods not fully paid for any time

Returns:
Goods “may” be returned to the Wētā Sydney only when the items supplied do not meet the technical specification of the product as described. In this case the cost of return freight is covered at the Wētā Sydney’s expense.
It is always the customers responsibility to ensure that the purchased product meets their requirements.

Refunds:
In the case of returns where the company has supplied an item that did not meet the described technical specification then the Wētā Sydney will provide a refund.
In cases where customers cancel orders for goods and services prior to delivery Wētā Sydney may refund at its discretion any deposits paid.
Specifically, Wētā Sydney does not refund deposits paid to reserve a charter boat nor deposits paid to secure a boat build slot more than 30 days after the deposit is paid, or reserve a boat (taking it off the open market).

Boat Delivery
Boats are delivered within the Greater Sydney metropolitan area free of charge. Delivery outside these regions will be charged on a fuel and wear basis for the return journey. Specialist boat transport deliveries may be used with the customer’s agreement.

Custom Colours
While every effort will be made to match the requested colour, there may be issues in production and colour matching which may affect the resulting finish. Variations to the colour, texture, surface and finish of the gelcoat may occur due to surface texture of the material, gloss levels and lighting. Wētā Sydney takes no responsibility for any variations in the colour, and will not accept any defects or faults on account of the natural variations in the gelcoat.
Dark colours are not recommended because they may fade badly and can highlight any defects.

Warranty
Wētā Marine Ltd provide a one-year warranty which gives you full after-purchase support and refunds if the product is faulty. The warranty does not include accident damage, misuse or wear. Damage to hulls is not included if launching in surf.
